I agree with you. There was a failing test case because of this though and that was the reason that I created the ticket originally. It is possible though that the test case is wrong

I'm not really sure this is an issue.
ACF acts in the same way in addition you could argue that it writes to outside the silent block.
cfhtmlhead and cfhtmlbody produce content even when wrapped in a cfsilent
